Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the WakeBoss mobile application and related website (together, the “Service”), operated by WakeBoss (“we”, “us”, or “our”). By downloading, accessing, or using WakeBoss, you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use WakeBoss

You must be able to form a binding contract in your country. If you are under the age required to consent to app store purchases in your region, you may only use WakeBoss with a parent or guardian’s involvement and their store account.

2. The Service

WakeBoss is a character-driven wake-up and habit app. You schedule alarms, complete morning missions (which may use the camera, microphone, motion sensors, or other device features), track progress such as XP and streaks, and optionally sign in to sync some data or connect with friends.

Features may change over time. We may update, suspend, or discontinue parts of the Service when needed for maintenance, security, legal, or product reasons.

3. Accounts

You may use parts of the Service as a guest, or create an account (for example with Apple, Google, or email). You are responsible for activity under your account and for keeping your sign-in methods secure. Usernames must not be offensive, misleading, or infringe others’ rights. We may reclaim or remove usernames that violate these Terms.

4. Subscriptions and payments

WakeBoss is offered on a paid subscription basis (monthly or yearly plans, as shown in the app). There is no free ongoing plan. Prices, trial offers (if any), and billing periods are displayed at purchase through the Apple App Store or Google Play.

• Payments are charged to your Apple or Google account.
• Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period in your store account settings.
• Manage or cancel in Settings → Manage Subscription in the app, or in your App Store / Google Play subscription settings.
• Refunds are handled by Apple or Google under their policies, except where local law requires otherwise.

5. Acceptable use

You agree not to:

• Misuse the Service, reverse engineer it beyond what the law allows, or disrupt it
• Upload unlawful, abusive, or infringing content
• Attempt to bypass the hard paywall, alarms, missions, or other integrity checks
• Use the Service to harm others or violate applicable law

6. Health and safety notice

WakeBoss is a productivity tool, not a medical device. Missions (including physical challenges) are optional activities you choose. Do not do anything unsafe for your health or surroundings. Consult a professional if you have concerns about sleep, exercise, or related conditions.

7. Intellectual property

WakeBoss, including its name, characters, artwork, audio, software, and branding, belongs to us or our licensors. You receive a limited, personal, non-exclusive, non-transferable license to use the app for its intended purpose while your subscription is active and you comply with these Terms.

8. Privacy

How we collect and use information is described in our Privacy Policy. By using the Service, you also acknowledge that policy.

9. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that alarms will always fire, that missions will always succeed, that the app will be uninterrupted, or that streaks/XP will never be lost due to device, OS, or network issues.

10. Limitation of liability

To the fullest extent permitted by law, WakeBoss and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the claim (or, if greater, the minimum amount required by mandatory consumer law).

11. Termination

You may stop using WakeBoss at any time and cancel your subscription via the store. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that should survive (including intellectual property, disclaimers, and limitations) will survive termination.

12. Changes

We may update these Terms. We will post the new version with an updated date. Continued use after changes become effective means you accept the revised Terms, except where local law requires additional notice or consent.
